DISCIPLINE POLICY

Eisenhower High School is committed to providing a safe and orderly learning environment for all students and staff. All Eisenhower High School students are required to conduct themselves in an appropriate and acceptable manner at all times when present in classrooms, hallways, at school-sponsored activities, on school grounds, and on the way to and from school. Responsible and mature citizenship ensures a positive and productive campus environment.

The Board of Education, as well as Eisenhower High School, believes that it is important for students to understand that they have a choice for their actions and that appropriate conduct benefits both them and others. Eisenhower High School has a Discipline Policy that reinforces the underlying belief that students are responsible for their own behavior. This Discipline Policy is based on a system of demerits. Students who are referred to the office for inappropriate behavior may receive demerits as a consequence of their actions. The number of demerits will be determined by the severity of the incident and will progressively increase each time a student is referred for the same violation of school rules.

The Eisenhower High School Discipline Policy is a paradigm for achieving appropriate, productive student behavior and ultimately increasing student achievement. Students will receive a “Notice of Disciplinary Action” each time they are assigned demerits as a consequence of their actions. This notice will state the number of demerits the student received for that particular incident as well as the total number of demerits the student has accumulated. A copy of this notice will be given to the student to take home for a parent/guardian signature to ensure that parents/guardians are aware of their student’s behavioral status. This Discipline Policy is effective for all students because it reinforces the belief that students can make appropriate decisions regarding their behavior.

Each teacher has specific expectations regarding student behavior in his/her classroom. The following Eisenhower High School rules apply to every student on campus:

  1. Treat others with consideration, dignity and respect.
  2. Respect the authority of ALL adults on campus.
  3. Follow the directions of ALL staff members.
  4. Respect the property of others.
  5. Be punctual and prepared for class.
  6. Contribute positively to the learning environment.
  7. Abide by the Eisenhower Dress Code.
  8. Abide by all school rules and regulations.

  4. SART/SARB (School Attendance Review Team/Board) referrals

  10. Recommendation for Expulsion

STUDENTS MAY BE SUBJECT TO IMMEDIATE SUSPENSION
FOR A VARIETY OF OFFENSES INCLUDING, BUT NOT LIMITED TO:

  1. Fighting/Instigating a fight
  2. Profanity directed towards a staff member
  3. Habitual disrespect or defiance towards staff
  4. Graffiti
  5. Vandalism of school or personal property
  6. Theft
  7. Possession/under the influence of controlled substances
  8. Sales of controlled substances
  9. Possession of a weapon or dangerous object
  10. Campus disturbance
  11. Bullying/Sexual harassment
  12. Horseplay causing injury to others

This Discipline Policy is not limited to the disciplinary offenses and consequences listed above. Extenuating circumstances may create unique situations for which the disciplinary action will be subject to the discretion of the administrator.

BEHAVIOR GUIDELINES

Every student is entitled to a safe and orderly learning environment. The majority of students have a positive attitude towards school and are conscientious about their academic performance. Unfortunately some students experience difficulty in maintaining an appropriate and respectful attitude toward school rules. Inappropriate behavior creates problems for the students themselves, as well as for fellow students, their parents/guardians, and school staff. When difficulties occur, disciplinary action must be taken in order to maintain a safe, orderly learning environment. Students are asked to sign their acceptance of safe school and network use responsibilities. Students who have excessive attendance or behavioral problems are asked to sign agreements. Refusal to sign in no way indicates these rules are not binding. It should also be noted that all inappropriate student behavior taking place adjacent to the Eisenhower High School campus or to and from school or at school activities will be addressed under the EHS Discipline Policy. In addition to school discipline, students may be cited for fighting, possession of controlled substances including tobacco, truancy, weapons, vandalism, and other unlawful behaviors. Driving and parking violations are subject to California Vehicle Regulations. The Rialto Police Department has the jurisdiction to cite vehicles parked in the student lot, staff lot and/or any other place on campus. Consequences may vary according to the seriousness of the infraction per administrative discretion.

Eisenhower High School Dance Guidelines

Dance movements and mannerisms must fall within the standards of social acceptability and good taste. Dancing commonly referred to as “dirty dancing”, “freaking” or movements which depict private acts, are sexually suggestive or are a distraction or bothersome to others are not allowed. Physically dangerous dancing or movements, such as “slamming” or “moshing”, are not allowed.

Individuals or couples engaging in such acts or movements will be removed from the dance and parents/guardians contacted. (No refunds will be made for removal from a dance for inappropriate behavior.)

SERIOUS VIOLATIONS OF THE EDUCATION CODE AND THE PENAL CODE MAY INCLUDE:

Fighting/Hazing

Fighting is never an acceptable means to resolve conflict. If a problem exists between or among students, they are to seek help from administration before the situation escalates to the fighting stage. Any student fighting or hazing will be suspended from school for not less than three (3) days and not more than five (5) days. Hazing includes but is not limited to “trash-canning, duct-taping, wedgies, play fighting, etc.”

The above misconduct will result in the following:

Any fighting or hazing causing serious injury to another person, except in self-defense, will result in the student being recommended for expulsion from the school district. A police report will be filed.

Bullying

The Rialto Unified School District is committed to providing a safe working and learning environment; takes seriously bullying or any behavior that infringes on the safety or the well-being of students, employees or any other persons within the District’s jurisdiction; and will not condone retaliation in any form when bullying has been reported. District policy continues to require all schools and personnel to promote among students and staff mutual respect, tolerance, and acceptance.

The California Department of Education (CDE) has developed and made available to school districts a policy model on the prevention of bullying and on conflict resolution. These policies are developed for the purpose of incorporating them into a district wide school safety plan. The attached documents are a sample policy for Bullying Prevention & Conflict Resolution, and Student Code of Conduct for Rialto Unified School District.

Rialto Unified School District Bullying (Cyberbullying) Prevention (Policy model) (Ed. Code 48900(a),(k),(o),(r),(s)

The Rialto Unified School District believes that all students have a right to a safe and healthy school environment. The district, schools, and community have an obligation to promote mutual respect, tolerance, and acceptance.

The Rialto Unified School District will not tolerate behavior that infringes on the safety of any student. A student shall not intimidate or harass another through words or actions. Such behavior includes: direct physical contact, such as hitting or shoving; verbal assaults, such as teasing or name-calling; and social isolation or manipulation.

The Rialto Unified School District expects students and/or staff to immediately report incidents of bullying to the principal or designee. Staff is expected to immediately intervene when they see a bullying incident occur. Each complaint of bullying should be promptly investigated. This policy applies to students on school grounds, while traveling to and from a school-sponsored activity, during the lunch period, whether on or off campus, and during a school-sponsored activity.

To ensure bullying does not occur on school campuses the Rialto Unified School District will provide staff development training in bullying prevention and cultivate acceptance and understanding in all students and staff to build each school’s capacity to maintain a safe and healthy learning environment.

Definition of Harassment and Bullying

Harassment or bullying of students or staff is an extremely serious violation of the Student Code of Conduct. It can also be a violation of criminal law. The District will not tolerate unlawful bullying and harassment on school grounds, or when traveling to and from school or a school sponsored activity, and during lunch period, whether on or off campus, or sending insulting or threatening messages by phone, e-mail, websites, or any other electronic or written communication. The physical location or time of access of a computer-related incident cannot be raised as a defense in any disciplinary action initiated pursuant to this policy.

“Harassment” means any threatening, insulting, or dehumanizing gesture, use of data or computer software, or written, verbal or physical conduct directed against a student or employee that:

"Bullying,” means systematically and chronically inflicting physical hurt or psychological distress on one or more students or school employees. It is unwanted and repeated written, verbal, or physical behavior, including any threatening, insulting, or dehumanizing gesture, by an adult or student, that is severe or pervasive enough to create an intimidating, hostile, or offensive educational environment; cause discomfort or humiliation; is carried out repeatedly and is often characterized by an imbalance of power; or unreasonable interference with the individual’s school performance or participation; and may involve but is not limited to:

  1. Unwanted teasing or taunting (verbal or non-verbal)
  2. Social exclusion
  3. Threat
  4. Intimidation
  5. Stalking
  6. Physical violence
  7. Theft
  8. Sexual, religious, or racial/ethnic harassment
  9. Public humiliation
  10. Destruction of property

“Cyberbullying,” sometimes referred to as internet bullying or electronic bullying, is defined as the “willful and repeated harm inflicted through the medium of electronic text”. It may involve:

Teachers should discuss this policy with their students in age-appropriate ways and should assure them that they need not endure any form of bullying. Students who bully are in violation of this policy and are subject to disciplinary action up to and including expulsion. ( Ed. Code 32261 Legislative findings, declarations, and intent; Ed. Code 48900, 48900.2, 48900.3, 48900.4, 48915(a) and 48915(c)).

Each school will adopt a Student Code of Conduct to be followed by every student while on school grounds, or when traveling to and from school or a school-sponsored activity, and during lunch period, whether on or off campus.

Conflict Resolution (policy model)

The Rialto Unified School District believes that all students have a right to a safe and healthy school environment. Part of a healthy environment is the freedom to openly disagree. With this freedom comes the responsibility to discuss and resolve disagreements with respect for the rights and opinions of others.

To prevent conflict, each school within the Rialto Unified School District will incorporate conflict resolution education and problem solving techniques into the curriculum and campus programs. This is an important step in promoting respect and acceptance, developing new ways of communicating, understanding, and accepting differing values and cultures within the school community and helps ensure a safe and healthy learning environment.

The Rialto Unified School District will provide training to provide the knowledge, attitudes, and skill students need to choose alternatives to self-destructive, violent behavior and dissolve interpersonal and intergroup conflict. Each school will adopt a Student Code of Conduct to be followed by every student while on school grounds, when traveling to and from school or a school-sponsored activity, and during lunch period, whether on or off campus.

Forgery

It is considered to be a forgery for any person who, with intent to defraud, signs the name of another person, or of a fictitious person, knowing that she/he has no authority to do so. This also includes altering legal documents. School or personal documents may include, but are not limited to:

Hate Violence

In addition to the reasons specified in Sections 48900 and 4900.2, a student in any of grades 4 - 12, inclusive, may be suspended from school or recommended for expulsion if the superintendent or the principal of the school in which the pupil is enrolled determines that the pupil has caused, attempted to cause, threatened to cause, or participated in an act of, hate violence, as defined in subdivision (e) of Section 233. Any student who believes he/she is a victim of hate-motivated behavior shall immediately contact a staff member, Principal or Coordinator for Nondiscrimination. Upon receiving such a complaint the Coordinator or Principal shall immediately investigate the complaint in accordance with school-level complaint process/grievance procedures as described in AR 5145.7-Sexual Harassment. AS PER OUR MISSION STATEMENT, THESE BEHAVIORS WILL NOT BE TOLERATED ON OUR CAMPUS. SUSPENSION AND/OR EXPULSION MAY RESULT FROM THE FIRST OFFENSE.

Threats, Assault and/or Battery Against a Staff Member

Any student who is found to have initiated an attack on, assaulted, used force with or threatened a school employee will be suspended. The appropriate law enforcement agency will be contacted and a report filed.

Using, possessing, or being “under the influence” of any drugs, alcohol, intoxicants; or possession or furnishing of any drug paraphernalia on school grounds, off campus during school hours, at any school sponsored function, or while traveling to or from school or school activities will result in appropriate disciplinary action including, but not limited to police notification, suspension and/or expulsion.

Drugs, Alcohol, Intoxicants

Selling, offering, arranging to sell, negotiating to sell, or furnishing any drugs/alcohol/intoxicants (including “look alikes”) or possessing quantities large enough to indicate a sale on school grounds, off campus during school hours, at any school sponsored function, or while traveling to or from school activities shall be subject to appropriate disciplinary action. Such action may include, but not be limited to, police notification, suspension, and/or expulsion. Student drivers are responsible for all illegal substances within their vehicle, no matter who is using or found to be in possession of such substances.

DANGEROUS OBJECTS

Explosives/Incendiaries/Setting Fires

This includes matches, lighters, firecrackers, etc., or false fire alarms. Possession of a "stink bomb" is considered a crime (P.C. 375) and is a misdemeanor/felony, depending on the circumstances. Possession of a “stink bomb” can be considered an expellable offense (E.C.48900-b and E.C. 48915-2). Expulsion may be recommended at the Principal's discretion. Depending on the circumstances, action may include any or a combination of the following:

Penal Codes: 451, 452, 453, 12303.3 and 12303.2.

Firearms, Knives, or Dangerous Objects

“Weapons” shall include, but not be limited to: zappers (stun guns), guns, “look-alike” weapons, any size knife, martial arts tools, razor blades, Mace, pepper spray, or any weapon specified in Penal Code Sections 626.9, 626.10, 12001, 2020, 12025, 12220, 653K, 12303.2, 12303.3. Any violation of the above may result in suspension and/or a recommendation for expulsion. Dangerous objects shall include, but not be limited to: laser pointers, stink bombs, and other objects capable of causing harm to others.

The Principal/Principal's designee of a school shall immediately suspend any pupil found to be in possession of a firearm, knife, or other dangerous object at school or at a school activity off school grounds and shall recommend expulsion of that pupil. The Principal/Principal’s designee shall confirm the following:

  1. The pupil was knowingly in possession of the firearm
  2. An employee of the school district verifies the pupil's possession of the firearm

Searches

Searches may be conducted when there is a reasonable suspicion that a student is in possession of items that are illegal and/or prohibited on campus. Areas that may be searched include, but are not limited to P.E. lockers, desks, cars, purses, backpacks, pockets, shoes and socks. General searches may be conducted in emergency situations. In order to provide a safe and secure learning environment, the Rialto Unified School District Board of Education has implemented a Random Search Program. The program is conducted on a random, “no-notice” basis at all secondary schools. The process utilizes an electronic (computerized) Random Selection Device along with hand-held metal (wand) detectors. A team of Campus Security Officers (both male and female), along with a school administrator conduct the searches. In addition, the Rialto Unified School District employs Interquest Detection Canines, Inc., to conduct searches with canines trained to detect drugs, alcohol and gun powder. If a student refuses to be searched, the police and/or the parents/guardians will be called to conduct the search.
